1. Agreement to Terms

By purchasing from Portland Earthquake Preparedness, LLC ("we," "us," or "our"), you agree to these Terms and Conditions. If you do not agree, do not purchase or use our services.

2. Our Service

We provide a 6-month earthquake preparedness program for Portland-area households. Each month, we deliver a curated set of supplies designed to help your household prepare for a Cascadia Subduction Zone earthquake. Deliveries are made to addresses within our defined service area only. If you are outside the specified service area then you must arrange to pick up your supplies after purchase.

3. Kit Sizes and Pricing

Kits are offered in four sizes. You select your kit size at checkout based on the number of people in your household. A ten-percent discount is applied to kits purchased all at once.

Pricing is subject to change. Any price changes will be communicated to active subscribers at least 30 days in advance and will not affect the current active 6-month program.

4. Product Substitution

Kit contents are subject to change at any time. Individual items may be substituted with comparable alternatives of equivalent or greater utility, or different brands or designs than what may be depicted on the website, without prior notice. We curate kits based on availability, quality, and preparedness value, and reserve the right to make substitutions in our sole discretion.

5. Packaging

Items may be delivered in their original manufacturer packaging or removed from the original packaging and re-packaged for inclusion in your kit. Actual packaging may differ from any images shown on our website. Packaging condition does not affect product functionality and is not grounds for a return or refund.

6. Billing

Your program is billed monthly through Stripe, Inc. By enrolling, you authorize us to charge your payment method on a recurring monthly basis for the duration of your 6-month program.

If a payment fails, we will notify you by email and attempt to retry the charge. No delivery will be made for any month in which payment has not been successfully processed. Repeated failures in payment may result in cancellation of the remainder of your program.

7. Cancellation

You may cancel future deliveries at any time by contacting us at the email address below, or by using the cancellation link in any pre-purchase notification email sent by Stripe prior to an upcoming charge. No refunds are issued for purchases already completed. Once a monthly kit has been charged and prepared for delivery, that purchase is final. Cancellation stops future charges; it does not reverse prior ones.

8. Delivery Area, Scheduling, and Responsibility After Delivery

We deliver within a defined service area covering portions of Portland and surrounding communities in Multnomah, Washington, and Clackamas counties. Not all addresses within these counties are eligible. Before purchasing, confirm your address is within our delivery area using the address lookup tool at pdxquakeprep.com/delivery-area. If a purchase is made for an address outside our service area and you do not arrange to pick up your kit(s), the order will be cancelled and we will issue a full refund.

All delivery dates are estimates. We cannot guarantee delivery on a specific date due to the nature of local logistics. We will notify you of your scheduled delivery window by email and will work with you on setting a mutually acceptable delivery date.

You are responsible for providing an accurate and accessible delivery address. Unless special arrangements are made in advance, kits will be left at your front door or building entrance. We are not responsible for failed deliveries due to an incorrect address or inaccessible entry.

Once a kit has been left at the provided delivery address, risk of loss passes to you. We are not responsible for theft, damage, or loss that occurs after delivery, including but not limited to theft from a porch, doorstep, or common area. We strongly recommend ensuring someone is available to receive your delivery or that your delivery location is secure. If you have specific delivery instructions, contact us before your scheduled delivery window.

If a delivery cannot be completed because no accessible drop location exists, we will make one (1) redelivery attempt. If the reattempt is unsuccessful, the delivery for that month is forfeited without refund and you must arrange to pick up your supplies from us.

9. Damaged Goods

You should inspect your kit upon delivery. If any item in your kit is visibly damaged, you must notify us within 30 days of delivery. We will, at our discretion, replace the damaged item or issue a partial credit toward a future delivery. Damage claims submitted after 30 days will not be honored. This is your sole remedy for damaged items.

10. Shelf Life and Customer Replenishment Responsibilities

Many emergency supplies have a limited useful life. We pass through all manufacturer shelf life parameters and expiration dates to you without modification — we make no representations about the useful life of any item beyond what the manufacturer provides.

We will send periodic reminder emails notifying you when commonly expiring items in your kit may be due for replacement, along with the option to purchase replenishment supplies from us. These reminders are a courtesy only. Receipt of a reminder — or failure to receive one — does not affect your responsibility to maintain your kit.

You are solely responsible for:

  • Inspecting your kit contents regularly and replacing expired or degraded items.
  • Ensuring that consumable supplies (batteries, medications, water, and similar items) remain current and functional at all times.
  • Ensuring that potentially dangerous items such as tools or medications are kept safe from children and are not otherwise misused.
  • Replenishing any items you use prior to an emergency, regardless of whether you have received a reminder from us.
  • Familiarizing yourself with the proper maintenance and use of the items in your kit.
  • Supplementing your kit for your particular needs and identifying items to which you or a member of your family may have an allergic or other medical reaction to.

11. Kit Contents, Limitations, and Customer Responsibilities

Our kits are designed to support household earthquake preparedness based on generally accepted emergency management guidance. Before purchasing, you must understand the following:

  • Food is not included. Our kits do not contain food. You are responsible for maintaining an independent food supply appropriate for your household size and dietary needs. We provide guidance on recommended food storage at pdxquakeprep.com/food-storage, including references to FEMA and Oregon OEM guidelines.
  • Water containers require filling and proper preparation by you. Where water storage containers are included, they are provided empty. Before filling, containers must be properly sanitized to prevent contamination — step-by-step sanitization instructions can be found at https://www.regionalh2o.org/emergency-preparedness/emergency-water-storage. We recommend storing at least 1 gallon per person per day for a minimum of 3 days, per FEMA guidelines. Stored water should be replaced periodically per manufacturer and public health guidance.
  • Supplies require active maintenance. See Section 10 above.
  • We do not guarantee that our kits will fully protect you, your household, or your property in the event of an earthquake or other emergency.
  • We do not tailor our kits to your particular medical or physical needs or conditions. You are responsible for identifying and removing any items in the kit that may potentially cause an adverse reaction or harm to you or a member of your family.
  • Kit contents are provided as a strong foundation for your emergency plan, not as a complete or certified emergency preparedness solution.

We strongly encourage all customers to review official guidance from the Oregon Office of Emergency Management (oregon.gov/oem), FEMA (ready.gov), and the City of Portland Bureau of Emergency Management (portland.gov/pbem).

Informational Binders

Your kit will include one or more informational binders of original writing, public-domain works produced by the Federal Government, and references to third-party sources to assist you in supplementing your kit and formulating a broader disaster preparedness plan. We retain full ownership of our original materials, which are not to be reproduced or resold for any purpose other than use by your personal household. The materials are not all-encompassing or definitive, and may contain errors or advice that is inappropriate for your particular situation, and you must exercise your own judgment to determine the extent to which you rely on the materials and whether further research must be conducted on any topic addressed by the materials.

12. Disclaimer of Warranties

WE DO NOT PROVIDE ANY WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WHERE A MANUFACTURER PROVIDES A WARRANTY ON AN INDIVIDUAL PRODUCT AND THAT WARRANTY IS TRANSFERABLE, IT PASSES THROUGH TO YOU. WHERE NO MANUFACTURER WARRANTY EXISTS, YOU HAVE NO WARRANTY RECOURSE FOR THAT ITEM EXCEPT AS PROVIDED IN THE DAMAGED GOODS SECTION ABOVE.

13. Assumption of Risk; Waiver and Release

WE CANNOT GUARANTEE THAT ANY KIT WILL PREVENT INJURY, DEATH, OR PROPERTY DAMAGE IN THE EVENT OF AN EARTHQUAKE OR OTHER DISASTER. BY PURCHASING FROM US, YOU VOLUNTARILY ASSUME ALL RISK OF PROPERTY DAMAGE, PERSONAL INJURY, DEATH, AND ANY OTHER HARM THAT MAY ARISE FROM YOUR USE OF, OR RELIANCE ON, OUR PRODUCTS.

YOU ACKNOWLEDGE THAT NO KIT CAN INCLUDE EVERY ITEM THAT MAY BE NEEDED IN AN EMERGENCY, AND THAT OUR SELECTION OF ITEMS TO INCLUDE — AND ANY DECISION NOT TO INCLUDE A PARTICULAR ITEM — DOES NOT CONSTITUTE A REPRESENTATION THAT THE KIT IS COMPLETE OR SUFFICIENT FOR YOUR SPECIFIC CIRCUMSTANCES. YOU ASSUME FULL RESPONSIBILITY FOR EVALUATING WHETHER YOUR KIT MEETS YOUR HOUSEHOLD'S NEEDS AND FOR SUPPLEMENTING IT ACCORDINGLY.

YOU WAIVE ANY AND ALL CLAIMS AGAINST PORTLAND EARTHQUAKE PREPAREDNESS, LLC — INCLUDING CLAIMS BASED ON NEGLIGENCE, CONTRACT, OR THE OMISSION OF ANY PARTICULAR ITEM FROM A KIT — AND RELEASE US FROM ALL LIABILITY FOR ANY LOSS, DAMAGE, INJURY, OR DEATH SUFFERED BY YOU OR ANY MEMBER OF YOUR HOUSEHOLD AS A RESULT OF USING, FAILING TO USE, OR RELYING ON PRODUCTS PURCHASED FROM US.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED A REFUND OF THE PURCHASE PRICE OF THE SPECIFIC KIT AT ISSUE, WITHOUT INTEREST. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow limitation of implied warranties or exclusion of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Portland Earthquake Preparedness, LLC and its officers, agents, and representatives from and against any claims, losses, damages, liabilities, and expenses — including reasonable attorneys' fees — arising out of or related to your use of our products or your violation of these Terms.

16. Arbitration

Any dispute arising from or related to these Terms or our products shall be resolved by binding arbitration before a single arbitrator under the rules of the Arbitration Service of Portland, conducted in Portland, Oregon. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs as determined by the arbitrator. Judgment on the arbitration award may be entered in any court of competent jurisdiction. Nothing in this section prevents us from seeking injunctive relief in a court of competent jurisdiction where appropriate. Both parties waive any right to a jury trial.

17. Force Majeure

We are not liable for any failure or delay in delivery caused by circumstances beyond our reasonable control, including but not limited to: acts of God; earthquake, flood, fire, or explosion; war, civil unrest, or terrorist acts; government orders or restrictions; labor disruptions; supply chain failures; or regional emergencies. In such cases we will notify you and resume deliveries as soon as reasonably practicable.

18. Intellectual Property

All content on pdxquakeprep.com — including text, design, branding, and kit documentation — is the property of Portland Earthquake Preparedness, LLC. You may not reproduce or distribute our materials without written permission.

19. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law provisions.

20. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.

21. Non-Waiver

Our failure to enforce any right or provision of these Terms on any occasion does not constitute a waiver of that right or provision going forward.

22. Entire Agreement

These Terms, along with the Website Terms of Use (available at pdxquakeprep.com/terms-of-use.html) and the Privacy Policy (available at pdxquakeprep.com/privacy.html), constitute the entire agreement between you and Portland Earthquake Preparedness, LLC with respect to our products and services, and supersede all prior agreements, communications, and understandings.

23. Changes to These Terms

We may update these Terms at any time. We will post the updated Terms on pdxquakeprep.com with a revised "last updated" date. For material changes, we will notify active subscribers by email. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
